Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Bespoke Analytics (“the Platform”), operated by Sterling Consulting Services. By creating an account or using the Platform, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into a binding agreement to use the Platform. By using the Platform on behalf of a company, you represent that you have authority to bind that company to these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate and complete registration information
  • Notify us immediately of any unauthorized use of your account
  • Not share your account credentials with third parties
  • Not create accounts through automated means or under false pretenses

3. Subscriptions & Billing

Free Trial

We offer a 14-day free trial on all paid plans with no credit card required. At the end of the trial, you may choose to subscribe or your account will revert to limited access.

Paid Plans

Paid subscriptions are billed monthly or annually in advance. All fees are in US dollars and are non-refundable except as described in our 30-day money-back guarantee below.

Money-Back Guarantee

If you are unsatisfied with the Platform within the first 30 days of your first paid subscription, we will issue a full refund upon request.

Price Changes

We may change our pricing at any time. We will provide at least 30 days' notice of any price increases before they take effect on your subscription.

Cancellation

You may cancel your subscription at any time through the Settings page. Your access continues until the end of the current billing period. We do not provide prorated refunds for cancellations mid-period.

4. Acceptable Use

You agree not to use the Platform to:

  • Violate any applicable law, regulation, or third-party rights
  • Upload or connect data sources you do not own or have rights to access
  • Attempt to reverse-engineer, decompile, or extract our proprietary algorithms
  • Scrape, crawl, or systematically extract data from the Platform
  • Interfere with or disrupt the Platform's infrastructure
  • Use the Platform for any illegal, harmful, or fraudulent purpose
  • Resell or sublicense access to the Platform without our written consent

5. Your Data

You retain ownership of all business data you connect to the Platform. By using the Platform, you grant us a limited, non-exclusive license to access your data solely to provide the analytics service. We do not sell your data or use it to train AI models. See our Privacy Policy for full details.

6. Intellectual Property

The Platform, including its design, code, trademarks, and content, is owned by Sterling Consulting Services and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements.

You retain all intellectual property rights in the questions you submit and any insights you export from the Platform.

7. AI-Generated Content Disclaimer

Bespoke Analytics uses artificial intelligence to generate data insights. While we strive for accuracy, AI-generated answers may contain errors or omissions. You agree that:

  • All AI outputs should be verified before making critical business decisions
  • We are not liable for business decisions made based on AI-generated insights
  • The confidence scores provided are estimates, not guarantees

8. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted access. We may suspend or modify the Platform for maintenance, security, or legal reasons. We will notify you in advance of scheduled maintenance where possible.

9. Limitation of Liability

To the maximum extent permitted by law, Sterling Consulting Services and its affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Platform. Our aggregate liability to you for any claim arising from these Terms will not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Sterling Consulting Services from any claims, damages, or expenses (including attorney's fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your account at any time for violations of these Terms, non-payment, or at our discretion with 30 days' notice. Upon termination, your right to access the Platform ceases immediately. We will provide you with a reasonable opportunity to export your data before account deletion.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except where prohibited by law.

13. Changes to These Terms

We may update these Terms periodically. We will notify you of material changes via email or a prominent notice on the Platform at least 14 days before the changes take effect. Continued use after that date constitutes acceptance of the new Terms.
